These Terms of Use set forth the terms and conditions of use for OneTouchVibrationTimer (the "App") provided by Mizukami Takamasa (the "Provider").All users of this application (hereinafter referred to as "users") must agree to and abide by the Terms of Use.If you do not agree to the Terms of Use, please stop downloading, installing and using this application.By downloading and installing this application, the user is deemed to have agreed to this terms and conditions.

Responsibilities and rights of users

The users right of use is non-exclusive.You may not sublicense, transfer, or succeed to the contractual status of the software to a third party.Users shall be responsible for preparing the equipment (including smartphones and tablets) and network environment to run this application at their own expense and responsibility.

Usage fees

In principle, this service is free of charge.

If the provider requires compensation for the use of the service, the user shall be notified in advance and consent shall be obtained.

Intellectual Property Rights

All rights, including copyrights, trademark rights, and portrait rights, related to all data, text, audio, video, illustrations, and information provided through this application belong to the provider or a third party that has the relevant rights.

Prohibited items

Users shall not engage in any of the following acts when using the Application.In addition, in the event that the provider or a third party suffers damage as a result of the user's violation, the user shall be liable to compensate for such damage.

• Use of this application for commercial or for-profit purposes beyond the scope of personal use.

• Reproducing, reprinting, or redistributing any of the images, data, information, etc. used in this application, regardless of whether they are free of charge or in any form, without prior written consent from the provider.
• Infringing on the copyrights, patent rights, utility model rights, design rights, trademark rights, know-how, or any other intellectual property rights of the provider or a third party.
• Engaging in inappropriate behavior to obtain privileges, etc.
• Engaging in any other activities that the provider judges to be inappropriate based on reasonable grounds.

This app is provided "as is".The provider does not warrant the completeness, usefulness, guaranteed operation, fitness for a particular purpose, compatibility with the equipment used, or any other matters of this application.In addition, the provider shall not be liable for any damages incurred by the user or a third party due to communication failures, defects or failures in system equipment, etc., or use of this application.In the event that this application calls up other applications or uses the functions of other applications through the operation of the user, the provider assumes no responsibility for the specifications, operation, or effects of said applications.

Modification, suspension, or termination of this application

The provider may change the contents, display, operation method, management method, etc. of this application, or suspend or terminate the provision of this application without prior notice to the user.In such cases, the provider shall not be liable for any events resulting from such changes or interruptions.In the event that a user violates any of the provisions of this Agreement, the provider may terminate this Agreement with such user without notice.The Company reserves the right to terminate the use of the Application for such users.

These terms and conditions are subject to change without prior notice without the prior consent of the user.If you use this application after the change, you will be deemed to have agreed to the change.In the event of a change to the Terms, the provider will notify or announce the change to the user in a manner that the provider deems appropriate, such as posting on the Application.

Handling of Personal Data

The provider shall handle personal information appropriately in accordance with the "Privacy Policy".Personal information acquired by the provider shall be limited to the scope necessary for the provision, operation, development, and improvement of the service and support for the user, and no more personal information than necessary shall be acquired without the user's consent.

Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Japan.In the event of a dispute between the provider and the user regarding these terms of use or application, the Tokyo District Court shall be the exclusive court of first instance.

The terms and conditions shall take effect on August 9, 2021.
